Zebrowski Opposes Court Ruling on MTA Tax

New York State Assembylman Ken Zebrowski called for action by the state legislature in the wake of an appeals court ruling that the Metropolitan Transit Authority payroll tax is constitutional.

The state Supreme Court Appellate Division overturned a judgement that the MTA tax was unconstitutional.

"I am disappointed in yesterday's court decision that reverses a lower court ruling and re-instituted the MTA payroll tax," Zebrowski said. "However, this only means that the state legislature must act now to repeal this unfair tax. I voted against this tax from its inception and continue to view it as counterproductive to economic development and unfair to Rockland County, which does not receive its fair share of MTA services. 

"I am currently sponsoring two bills, A 1443 and A 775, that phases out the tax completely and eliminate it for our community colleges. In 2011, I helped eliminate the tax for all businesses with a payroll under $1.25 million and reduce it for businesses with a payroll under $2 million. The law also exempted self employed individuals with income under $50,000. This was a good start, but I now call upon my colleagues in the legislature and Governor Cuomo to join me in eliminating this tax altogether."

Zebrowski said if the legislature does come back for a special session, the MTA tax should be at the top of the agenda.
