Dad gets 5 To 15 Years In Prison For Beating Death Of 5-Month-Old Daughter

Infant died after incident in Haverstraw apartment.

A Rockland County father has been sentenced to 5 to 15 years in state prison for the 2011 beating death of this 5-month-old daughter.

Michael Aviles, 42, of 153 Hudon Ave., Haverstraw, was convicted of second-degree manslaughter and criminally negligent homicide in January after a trial in Rockland County Court in New City. He was found guilty of causing the death of his daughter, Michelle.

said that in the early morning hours of Jan. 16, 2011, the infant suffered multiple fractures to her skull and ribs, and internal bleeding following what was described as a savage beating by Aviles in the apartment he shared with Lissette Capellan, 23.

Zugibe said the unresponsive infant, wrapped in a towel and wearing a diaper, was later driven to Nyack Hospital by the Aviles. After being transferred to Westchester Medical Center in Valhalla, the infant was pronounced dead at about 11:45 a.m. that same day.

In addition to the 5 to 15 years in state prison, Aviles was ordered to serve 1 1/3 to 4 years on the criminally negligent homicide count. Executive Assistant District Attorney Stephen Moore and Senior Assistant District Attorney Patricia Gunning prosecuted the case.

Very sad an infants life is worth soo little:( Ive heard of longer time for a lot less of a crime!

Any person capable of beating a 5 month old to death doesn't deserve to live. Only 5 years for this crime is ridiculous. She potentially had 75 or more years to live and he only gets 5 for taking that away...

If a person can do this to a baby, he is capable of much more evil! He needs to spend at least 35 years in prison, so when he comes out he will be in his 70's and not physically capable of doing harm to anyone else! Where was the mother during this horrible beating???

If a person kills another and it's not self defense then that person must be put to death. Why isn't that a national law?
